Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of the SimplizIT platform operated by SimplizIT LLC ("SimplizIT," "we," "us"). By accessing or using our services, you agree to these Terms.

2. Service Description

SimplizIT provides AI-powered dispatch, scheduling, and communication software for field service businesses. Our platform includes automated job assignment, GPS-based worker tracking, SMS customer communication, appointment management, and approval workflows.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials.
You are responsible for the accuracy of customer and worker data you enter into the platform.
You must obtain appropriate consent from your customers before we send them SMS messages on your behalf.
You must comply with all applicable laws regarding communication with your customers (TCPA, state regulations).

4. SMS Messaging Terms

By using our SMS features, you agree that:

You have obtained consent from recipients to receive service-related text messages.
Messages will be sent only for appointment coordination, service updates, and operational communication.
Recipients can opt out at any time by replying STOP.
We will honor all opt-out requests immediately.
Message frequency depends on service activity (typically 2-5 messages per appointment).
Standard message and data rates may apply to recipients.

5. Acceptable Use

You may not use SimplizIT to:

Send unsolicited marketing or promotional messages
Transmit spam, phishing, or fraudulent content
Violate any applicable laws or regulations
Share or resell access to the platform without authorization
Attempt to reverse-engineer, copy, or interfere with the platform's operation

6. Data Ownership

You retain ownership of all customer, worker, and business data you provide to the platform. We do not claim ownership of your data. We use your data solely to provide the services described herein.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We will notify you of planned maintenance in advance when possible. We are not liable for service interruptions caused by third-party providers (AWS, carriers).

8. Limitation of Liability

SimplizIT is a coordination tool. We are not responsible for the quality of work performed by your technicians, disputes between you and your customers, or business decisions made based on AI recommendations. Our liability is limited to the fees paid for the service in the preceding 12 months.

9. Termination

Either party may terminate service with 30 days written notice. Upon termination, we will provide data export within 30 days. Data is deleted from our systems within 90 days of termination unless legally required to retain.

10. Changes to Terms

We may update these Terms with 30 days notice via email. Continued use after changes take effect constitutes acceptance.
